Prosecutor Independence (At Least in Italy)

On Thursday, November 5, 2009, Democracy Now! host Amy Goodman conducted an interview with Italian prosecutor Armando Spataro, who successfully obtained a conviction (in absentia) of the CIA operatives who kidnapped an Egyptian cleric on the streets of Milan, Italy in 2003.

Of particular note is this comment by Mr. Spataro:

I think that it’s important that the Americans could know the Italian system of law. According to this system, the prosecutors are absolutely independent by the political power. Not only according to our constitution, we are obliged to prosecute anyone for any crime news we know. And it’s clear that this is a guarantee for the independence of the prosecutor in charge, but also is a guarantee for the citizen, because they are all on the same plane before the justice.

This is in keeping with the statement in my previous post that the United States must be a rule of law nation. Our “fearless leaders” should take note: No one is above the law.
